Terms of Sale

Effective from 8 October 2026

Who we are

This website, and the products offered on it, are run and sold by Peker Consultancy Limited. Our full company details are set out in our Business Details, and you can email us at any time at info@berno.co.uk.

How an order becomes a contract

Please make sure your order and delivery details are correct before you submit them. Submitting an order means you are offering to buy from us; the contract between us only comes into existence once we accept that offer and send you an order confirmation.

Until we accept it, we may turn down an order where: the item is not available; the payment is not authorised; a price or product description contains an obvious mistake; the order looks fraudulent; or content you have supplied is unlawful or appears to breach someone else's rights. If we have already taken payment for an order we cannot accept, you will receive a refund of the amount paid.

Prices and payment

You will see the price of each product and any delivery charge before you reach checkout. We start making or posting your order only after your payment has been authorised. A price change only affects orders placed after it takes effect. Once your order has been accepted, its price stays the same, except where you consent to a new price or a legal requirement means it must change.

Personalising your item

It is up to you to check every name, date, message, delivery detail, image and any other personalisation information before you order or approve a proof, because we make your item using the details you have supplied or approved.

If you need to change something, let us know straight away. We will do our best to help while production has not yet started, but after we accept an order, or once we start making it, we cannot promise that changes or a cancellation will still be possible.

Made-to-order and personalised items are not normally returnable for a simple change of heart. Your rights are not affected where an item is faulty, damaged or not as described, or where it differs from the personalisation details you supplied or approved.

Photos, wording and other content you send us

By sending us any photo, picture, logo, text or other material to include on a personalised product, you confirm that you own the copyright in it, or that the copyright owner has given you permission or a valid licence to use it in this way. You also confirm that you hold any other permission reasonably needed to use it and that using it will not infringe the privacy, confidentiality or legal rights of any other person.

You allow us to use this material only as far as is reasonably needed to produce and deliver your order and to help you with it afterwards. We can decline material that is unlawful or abusive, or that appears to breach someone else's rights.

Codes, gift cards and vouchers on your product

Where you ask us to print a gift card number, voucher or redeemable code on a personalised product, you confirm that you have the right to use and pass on that code, and that you would like it to appear on the item. Checking the code is correct, and keeping it private both before and after delivery, is your responsibility. Please bear in mind that the code could be redeemed by anybody who gets to see it.

Where a loss arises because you disclosed the code or someone else used it, that loss is not our responsibility, except where it resulted from us not taking reasonable care. We can also decline any code or content that appears to be unlawful, fraudulent or unauthorised.

How your finished product may look

We work to show and print our products as accurately as possible. However, small variations in on-screen colour, printed colour, positioning, trimming or materials can occur within normal production tolerances. If we have warned you that an image you provided may not print clearly, its quality and resolution are your responsibility. None of this limits your rights if we make a production error or if the product falls short of what the law requires.

Delivery

Our Delivery Information page and the checkout show the delivery methods available, what they cost and how long they are expected to take.

Delivery dates are estimates, and events outside our reasonable control may affect them. If there is a delivery problem, we will make reasonable efforts to update you and to put it right. Your statutory rights in relation to late or failed delivery are not removed by anything in this section.

Returning or cancelling an order

Our Returns, Refunds & Cancellations policy explains that eligible items without personalisation can be sent back within 30 days, sets out the rules that apply to personalised items, and describes what we do when an item arrives faulty, damaged or wrong, or does not match its description.

Your statutory consumer rights are not limited by anything in these Terms or in that policy.

Our liability to you

We are liable for loss or damage you suffer that was foreseeable as a result of us breaking these Terms or not acting with reasonable care and skill. Unless the law requires otherwise, we are not liable for: loss that nobody could reasonably have foreseen; business losses linked to a consumer purchase; or problems that result from incorrect details or unlawful material you gave us.

We do not exclude or limit our liability where our negligence causes death or personal injury, for fraud or fraudulent misrepresentation, for your statutory consumer rights, or for any other liability that the law does not allow us to exclude or limit.

Your personal information

Our Privacy Policy explains how we collect and use your personal information.

Updates to these Terms

We may revise these Terms for future use of the website and future orders. Any order we have accepted continues to be governed by the Terms that applied when we accepted it, except where you agree to something different or a change is legally required.

Governing law

English and Welsh law applies to these Terms and to any order you place with us. Consumers who live in Scotland or Northern Ireland still benefit from the mandatory legal protections of their home nation and can start proceedings in the courts that are open to them there.

Questions

If you have a question about your order or anything in these Terms, please email info@berno.co.uk.
